1. Parties and Definitions

"Heartistry Stays" refers to the short-term rental hospitality brand owned and operated by Sarthak Shrivastava ("Host"), a proprietorship under the parent entity M/S Raghav Enterprises, with properties located in Bhopal and Jabalpur, Madhya Pradesh, India. For all legal, tax, and compliance purposes, M/S Raghav Enterprises is the registered business entity operating Heartistry Stays.

"Qord" (accessible at qord.in) is the technology platform and marketplace operator that facilitates bookings and collects payments on behalf of Heartistry Stays. Qord is an independent entity and acts solely as a marketplace intermediary and payment collection agent — it is not the property owner, employer of the Host, or provider of accommodation services.

"EaseBuzz" is the third-party payment gateway through which Qord processes guest payments.

"Guest" means any individual who makes or attempts to make a booking via the Heartistry Stays website or Qord-powered booking flows.

"Booking" means a confirmed reservation of a Heartistry Stays property for a specified stay period.

2. Acceptance of Terms

By visiting the Heartistry Stays website, initiating a booking, or completing payment, the Guest unconditionally accepts these Terms & Conditions, along with the Privacy Policy, Payment & Billing Policy, Cancellation & Refund Policy, and House Rules, all of which are incorporated herein by reference.

These terms constitute a binding legal agreement under the laws of India. Guests who are minors (below 18 years of age) must obtain parental or guardian consent before making a booking.

3. Booking Contract Formation

A binding booking contract is formed between the Guest and Heartistry Stays (represented by Sarthak Shrivastava) at the moment Qord confirms the booking and issues a booking confirmation to the Guest via email or WhatsApp. Receipt of a payment confirmation alone does not constitute a booking confirmation.

Heartistry Stays reserves the right to cancel any booking prior to issuance of a confirmation in the event of errors in pricing, availability conflicts, or force majeure. In such cases, a full refund will be issued within 5–7 business days.

4. Qord's Role as Marketplace Operator

Qord acts as a technology intermediary and payment collection agent. When you book via a Qord-powered flow, your payment is received by Qord on behalf of Heartistry Stays. Qord then remits the applicable amount to Heartistry Stays after deducting any agreed platform fees.

Qord does not own, manage, or operate any of the properties listed on this website. Qord does not employ the Host. The accommodation contract is solely between the Guest and Heartistry Stays / Sarthak Shrivastava.

5. Use of the Website

The Heartistry Stays website is provided for personal, non-commercial use only. You agree not to:

• Reproduce, copy, or redistribute any content without prior written permission;
• Use automated tools, bots, or scrapers to access the website;
• Attempt to gain unauthorized access to any part of the website or its systems;
• Submit false, fraudulent, or misleading information during the booking process.

6. Intellectual Property

All content on this website — including photographs, text, logos, and design — is the intellectual property of Heartistry Stays or is used with permission. Nothing on this website grants any license or right to use such content without prior written consent from Heartistry Stays.

7. Limitation of Liability

To the fullest extent permitted by applicable Indian law:

• Heartistry Stays and Sarthak Shrivastava shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or stay at a property;
• Qord shall not be liable for the quality, safety, or suitability of any property listed on this website;
• Total liability of Heartistry Stays for any claim shall not exceed the booking amount paid by the Guest for the relevant stay.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Indian law.

8. Governing Law and Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India, including but not limited to the Consumer Protection Act 2019, the Information Technology Act 2000, and applicable RBI guidelines. Subject to the Dispute Resolution Policy, disputes shall be subject to the exclusive jurisdiction of courts in Bhopal, Madhya Pradesh, India.

9. Amendments

Heartistry Stays reserves the right to amend these Terms & Conditions at any time. Changes take effect upon posting to this website. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the website or completion of a booking after any amendment constitutes acceptance of the revised terms.

For bookings already confirmed before an amendment, the terms in effect at the time of booking confirmation apply.

10. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
